Organizer: Asociația Zestrea Silvană, operated through DanielSignatureTours (“Organizer”).
This document sets the internal rules, participant obligations, and Organizer responsibilities applicable to the international camp/workshop taking place in Romania. It is designed to align with the general legal framework applicable in Romania (including package travel rules where relevant, civil liability, copyright, and data protection). This is a template and does not replace individualized legal advice.
Article 1 – Definitions
Camp / Program: The multi-day itinerary, services, and activities offered by the Organizer.
Participant: Any person registered and accepted into the Camp.
Services: Accommodation, ground transport, meals as specified, guiding/translation, and educational sessions, as described in the itinerary and booking materials.
Supplier: Any third party providing services (hotel, restaurant, transport company, museum, etc.).
Materials: Any photos, videos, audio, notes, or other content created during the Camp.
Article 2 – Scope and Acceptance
2.1. These Rules apply to all Participants from the moment of registration and/or payment of any fee.
2.2. By registering, the Participant confirms they have read, understood, and accepted these Rules, the itinerary, and the booking terms communicated by the Organizer.
Article 3 – Eligibility and Participation Conditions
3.1. Participants must be at least 18 years old. Minors are not accepted unless explicitly confirmed in writing by the Organizer and accompanied by a legal guardian at all times.
3.2. Participants must be physically able to join outdoor walks, transfers, and standard travel conditions. Any medical conditions or dietary restrictions relevant to safety must be disclosed before arrival.
3.3. Participants are responsible for passports/IDs, visas (if applicable), and compliance with Romanian entry requirements.
Article 4 – Registration, Fees, and Payments
4.1. Registration is confirmed only after the Organizer receives (i) the completed registration form, (ii) required identification details for bookings, and (iii) the applicable payment(s).
4.2. The fee includes only the Services explicitly listed as included in the published itinerary/offer. Anything not expressly included is excluded.
4.3. Unless otherwise stated, bank fees, currency conversion costs, and international transfer charges are borne by the Participant.
Article 5 – Changes, Cancellations, and Refunds
5.1. The Organizer may adjust the order of visits or replace locations with comparable alternatives for operational, safety, weather, accessibility, or Supplier-related reasons, while preserving the overall quality and intent of the Program.
5.2. Participant cancellation terms (deadlines, penalties, refunds) are those stated in the booking offer/contract provided at purchase.
5.3. Where the Program qualifies as a “package” under Romanian Government Ordinance no. 2/2018, statutory rights and Organizer liability rules apply.
Article 6 – Participant Conduct and Community Respect
6.1. Participants must respect local customs, religious sites, and community norms.
6.2. Any form of harassment, discrimination, aggressive behavior, or intimidation is prohibited.
6.3. Participants must follow instructions from the Organizer team (mentor, assistant, local guide/translator) regarding access, timing, and conduct.
6.4. Alcohol is permitted only in moderation and never during safety-critical activities or when it affects conduct. Illegal drugs are strictly prohibited.
Article 7 – Safety, Risk, and Personal Responsibility
7.1. Travel and outdoor activities carry inherent risks. Participants take part at their own risk, within the limits of mandatory legal liability.
7.2. Participants must use appropriate clothing/footwear, carry essential personal medication, follow local safety rules, and avoid unsafe actions.
7.3. The Organizer may exclude a Participant from an activity if their conduct endangers themselves or others. No refund is owed for unused Services; additional costs are borne by the Participant.
7.4. Participants are strongly advised to carry adequate travel/medical insurance covering Romania, including liability coverage.
Article 8 – Equipment and Property
8.1. Participants are solely responsible for their equipment and data. The Organizer is not responsible for loss/theft/damage/data loss, except where required by law.
8.2. Participants must not leave equipment unattended.
8.3. Any damage caused by the Participant to venues/vehicles/third-party property must be fully compensated by the Participant.
Article 9 – Drones and Special Gear
9.1. Drone use is allowed only if legally permitted and if the Organizer/location owner grant permission.
9.2. The Participant bears full responsibility for legal compliance, safety, and any penalties/damages.
Article 10 – Image Rights, Consent, and Model Releases
10.1. Participants must obtain informed consent when photographing identifiable persons in private spaces or where consent is expected.
10.2. For arranged portrait sessions, model releases may be provided; Participants must comply with their scope/limitations.
10.3. Participants must avoid humiliating, exploitative, or discriminatory portrayals.
10.4. Participants must respect location rules (no-flash, no-tripod, fees, restricted areas).
Article 11 – Copyright and Use of Photographic Works
11.1. Participants retain copyright over works they create; Romanian law protects works automatically upon creation.
11.2. The Organizer may request a limited, non-exclusive license to use selected Participant images for promoting future editions only with prior written consent and with credit where possible.
11.3. Participants must not use the Organizer’s trademarks/logos in a way implying endorsement outside the Camp without written permission.
Article 12 – Confidentiality and Community Protection
12.1. Participants must not publish sensitive personal information about hosts/community members without explicit consent.
12.2. If a host/location requests no-publication or delayed publication, Participants must comply.
Article 13 – Data Protection (GDPR)
13.1. The Organizer processes Participant data for registration, logistics, bookings, invoicing, and safety communications in line with GDPR and Romanian implementing measures.
13.2. Participants may request the Organizer’s privacy notice (purposes, retention, recipients/Suppliers, rights).
13.3. Participants are independent data controllers for personal data collected in their own projects and are responsible for their own compliance where applicable.
Article 14 – Organizer Responsibilities
14.1. The Organizer delivers the Services as described and coordinates logistics, including mentor/assistant/local guide/translator as applicable.
14.2. The Organizer takes reasonable measures for safety during organized activities (briefings, planning).
14.3. The Organizer is responsible for proper performance of included travel services to the extent required by law (including package rules where applicable).
14.4. The Organizer is not responsible for failures caused by the Participant, unforeseeable actions of unrelated third parties, or force majeure, within the limits of Romanian law.
Article 15 – Limitation of Liability
15.1. To the maximum extent permitted by law, the Organizer is not liable for indirect/consequential losses.
15.2. Aggregate liability (where legally permitted) is limited to the amount paid, except for non-excludable liability (intent/gross negligence, death/personal injury caused by Organizer, etc.).
15.3. Nothing excludes mandatory consumer rights where applicable.
Article 16 – Force Majeure
16.1. Force majeure is an external, unforeseeable, absolutely invincible, and unavoidable event under Romanian civil law.
16.2. In force majeure situations, the Organizer may modify/suspend/cancel parts of the Program. Refunds/credits follow applicable law and the booking contract, considering non-recoverable Supplier costs.
Article 17 – Complaints and Resolution
17.1. Participants should notify the Organizer immediately on-site to allow prompt remedy.
17.2. If unresolved, complaints should be submitted in writing within 14 calendar days after the Program ends.
17.3. Disputes are first attempted amicably; failing that, Romanian courts apply, unless mandatory consumer rules provide otherwise.
Article 18 – Governing Law and Language
18.1. Governed by Romanian law and applicable EU law.
18.2. Working language is English. If a Romanian version exists, it may prevail for interpretation under Romanian law.
Article 19 – Final Provisions
19.1. The version communicated at booking applies to the Participant.
19.2. Invalidity of a clause does not affect the rest.
